Assault & Menacing

Assault is when someone physically hurts a person. Menacing is when someone threatens or scares another into believing they are going to be seriously hurt right then and there.

In Colorado, Assault charges are classified as first, second, or third degree Assaults.

  • First and second degree Assaults are felony crimes. These are the most serious kind of crimes. Felony crimes often lead to prison sentences.
  • Third degree Assaults are misdemeanors.  
  • Menacing charges are misdemeanors unless a deadly weapon was used or threatened, then it is a felony.
