Personal Injury

Personal injury lawsuits are filed to collect money to pay for injuries, regardless of whether a criminal case was filed.  This can include physical injuries, mental injuries, or injuries to a reputation, for example, defamation or revenge porn cases. It is best to talk to a lawyer to decide if and how to file a lawsuit.

A victim may file a personal injury lawsuit if they think three things happened:   

  1. The victim was harmed in some way. This is called injury.
  2. Someone else caused the injury. This is called liability.
  3. The victim had losses. This is called damages.

The person who files the lawsuit is called the Plaintiff. The person who the lawsuit is against is called Defendant. Lawsuits usually have to be filed in a certain amount of time after the injury happens. The time limit is called a “statute of limitations.” The statute of limitations varies, but can be as little as one year.
